Zoning Board of Appeals Summarized


The Board of Appeals for the Town is established pursuant to 30-A M.R.S.A. 2691. The Board of Appeals shall consist of five members and town associate members appointed by the Board of Selectmen. All records of the Board of Appeals shall be public record. A quorum shall consist of three members. All decisions shall be by a simple majority vote, except as noted in section 45-49 (a.) The Board of Appeals shall adopt rules necessary to conduct its affairs and in keeping with the provisions of the ordinance. All meetings shall be open to the public. The Board shall keep minutes of its proceedings showing the vote of each member upon each question or of absence or failure to vote and shall keep records of its examinations and other official actions all of which shall be a public record and be immediately filed in the office of the Board.


The Board of Appeals shall hear and decide on administrative appeals and variance appeals. Administrative appeal is where an aggrieved person or party alleges error in any permit, order, requirement, determination or other action by the Planning Board or the Code Enforcement Officer. Variance appeal involves the relaxation of the regulations affecting height, area, and size of structures, size of yards or open spaces, or other types of variance specifically provided by Chapter 45.
